1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you and Chitra ("Chitra", "we", "us", or "our") and govern your access to and use of our AI-powered social media post generator, app, and website (together, the "Services"). By creating an account or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.
3. Your Account & Approval
Your mobile phone number is your unique account identifier and is verified through a one-time password (OTP). New accounts must be approved by an administrator before the post generator becomes available; until then your account exists but cannot generate posts, and we are under no obligation to approve any account. You are responsible for maintaining the confidentiality of access to your device and account and for all activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are associated with fraud or abuse.
4. The Services
Chitra generates social media captions, hashtags, and images from the prompts you provide and the brand kit you save. Generation is performed by third-party AI models and runs asynchronously, so results take time to produce and may occasionally fail. We may apply fair-use limits on how many posts can be generated in a given period, and we may change, suspend, or discontinue any part of the Services at any time.
5. Your Content
You retain ownership of the prompts, brand kit details, logos, and reference images you provide ("Your Content"). You grant us a limited licence to host, process, and transmit Your Content — including sending it to our AI model providers — solely to operate the Services and produce the output you request. You represent and warrant that you own or have the necessary rights to Your Content, and that it does not infringe the intellectual property, privacy, or other rights of any third party. In particular, do not upload logos, trademarks, photographs, or likenesses you are not authorised to use.
6. Generated Output
Subject to your compliance with these Terms, you may use the captions, hashtags, and images Chitra generates for you, including for commercial purposes. Because AI models can produce similar results for different users, we do not warrant that any output is unique to you, and we make no representation that output is free of third-party rights. AI-generated output may be inaccurate, misleading, or unsuitable — you are responsible for reviewing it before publishing, and for ensuring anything you publish complies with applicable law, advertising and disclosure rules, and the policies of the platform you publish to.
7. Acceptable Use
You agree not to:
- use the Services for any unlawful, fraudulent, or abusive purpose;
- generate content that is defamatory, hateful, harassing, sexually explicit, or that depicts violence or self-harm;
- generate content that impersonates a real person or organization, or that is designed to deceive, including fake endorsements, reviews, or news;
- upload or generate content that infringes any third party's intellectual property, privacy, or publicity rights;
- attempt to bypass content filters, rate limits, or the account approval gate;
- access the Services through automated means, scrape, or reverse engineer any part of them;
- interfere with, disrupt, or compromise the security or integrity of the Services;
- create multiple or fake accounts, or use another person's account without permission.
We may remove content and suspend accounts that we reasonably believe breach this section.
8. Connected Social Accounts
If you connect a Facebook, Instagram, or other social account, you authorise us to publish content to that account at your direction. You remain responsible for everything published under your accounts and for complying with each platform's own terms and policies. Those platforms are third-party services we do not control; they may reject, remove, or restrict content, or change or revoke access at any time. You can disconnect a linked account at any time.
9. Intellectual Property
The Services, including their software, design, text, and branding, are owned by Chitra or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms. You may not copy, modify, distribute, or create derivative works of the Services without our prior written consent. This section does not restrict your rights in Your Content or in the output generated for you.
10. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, that any generation request will succeed, or that generated content will be accurate, original, or fit for your intended use.
11. Limitation of Liability
To the fullest extent permitted by law, Chitra and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or reputation, arising out of or relating to your use of the Services or anything you publish using them. Our total aggregate liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim and INR 1,000 (one thousand rupees).
12. Indemnification
You agree to indemnify and hold harmless Chitra and its partners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, content you upload or publish, your violation of these Terms, or your infringement of any rights of a third party.
13. Termination
You may stop using the Services and delete your account at any time from within the app. We may suspend or terminate your access at our discretion, including for breach of these Terms. Upon termination, your right to use the Services ceases and your stored content may be deleted. Provisions that by their nature should survive termination will continue to apply.
14. Changes to the Services or Terms
We may modify or discontinue the Services, in whole or in part, at any time. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you through the Services. Your continued use after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws rules. You agree to submit to the exclusive jurisdiction of the competent courts located in India for the resolution of any disputes arising out of or relating to these Terms or the Services.
