1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you and Gyanee ("Gyanee", "we", "us", or "our") and govern your access to and use of our AI-powered chat assistant, app, and website (together, the "Services"). By creating an account or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.
3. Your Account
Your mobile phone number is your unique account identifier and is verified through a one-time password (OTP). You are responsible for maintaining the confidentiality of access to your device and account and for all activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are associated with fraud or abuse.
4. The Services
Gyanee helps you discover coupons and deals from third-party merchants through an AI assistant. The assistant surfaces offers retrieved from our catalogue; it does not sell products directly. Deals, prices, availability, and offers are set by merchants and affiliate networks and may change or expire at any time without notice.
5. Deals, Offers & How We Stay Free
- Gyanee is free to use. We earn affiliate commissions when you make a qualifying purchase through a link in the Services, and this is how we fund the Services. It never adds anything to the price you pay the merchant.
- For a purchase to be attributed to us, you must reach the merchant through a link provided in the Services without blocking cookies or tracking parameters. We do not control whether a merchant or affiliate network reports a purchase to us.
- Deals and offers are provided for discovery only. Merchants set and may change prices, availability, and offer terms at any time, and we do not guarantee that any offer will be available or honored.
6. Acceptable Use
You agree not to:
- use the Services for any unlawful, fraudulent, or abusive purpose;
- attempt to game, manipulate, or circumvent deal tracking or attribution;
- access the Services through automated means, scrape, or reverse engineer any part of them;
- interfere with, disrupt, or compromise the security or integrity of the Services;
- create multiple or fake accounts, or use another person's account without permission;
- submit content that is unlawful, infringing, harmful, or otherwise objectionable.
7. AI-Generated Content
Responses from the assistant are generated by large language models and may occasionally be inaccurate, incomplete, or out of date. The assistant is designed to reference only deals from our catalogue, but you should verify offer details, prices, and terms on the merchant's site before purchasing. The Services do not constitute financial, legal, or professional advice, and you rely on AI-generated content at your own discretion.
8. Third-Party Merchants & Links
The Services contain links and redirects to third-party merchants and affiliate networks. We do not control and are not responsible for their products, pricing, content, policies, or practices. Any purchase you make is a transaction solely between you and that merchant, governed by the merchant's own terms and privacy policy.
9. Intellectual Property
The Services, including their software, design, text, and branding, are owned by Gyanee or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without our prior written consent.
10. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any deal, price, or offer will be available or honored.
11. Limitation of Liability
To the fullest extent permitted by law, Gyanee and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Services. Because the Services are free to use, our total aggregate liability for any claim relating to the Services will not exceed INR 1,000 (one thousand rupees).
12. Indemnification
You agree to indemnify and hold harmless Gyanee and its partners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or your infringement of any rights of a third party.
13. Termination
You may stop using the Services and delete your account at any time from within the app. We may suspend or terminate your access at our discretion, including for breach of these Terms. Upon termination, your right to use the Services ceases. Provisions that by their nature should survive termination will continue to apply.
14. Changes to the Services or Terms
We may modify or discontinue the Services, in whole or in part, at any time. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you through the Services. Your continued use after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws rules. You agree to submit to the exclusive jurisdiction of the competent courts located in India for the resolution of any disputes arising out of or relating to these Terms or the Services.
